READ THESE CONDITIONS CAREFULLY
These General Conditions will expressly regulate the relations between INDUSTRIAS VALLS 1 S.A., calle AVENIDA BALMES, 16, 08700 IGUALADA (BARCELONA), SPAIN, with VAT NO: A59060491 (hereinafter 'INDUSTRIAS VALLS 1 S.A.') and third parties (hereinafter, 'users') who sign up as users and/or acquire products through the online shop from the official website of INDUSTRIAS VALLS 1 S.A. (http://WWW.PUNTOBLANCO.COM', hereinafter the shop').
User obligation
The user undertakes, with a general nature, to use the shop, purchase the products and use each one of the shop's services diligently, observing the law, moral, public order and the provisions of these general conditions, and must likewise refrain from using them in any way that might impede, damage or affect the normal operation and enjoyment of the shop by the users or which might damage the assets or rights of INDUSTRIAS VALLS 1 S.A., its suppliers, users or in general of any third party.
Products and Prices
- INDUSTRIAS VALLS 1 S.A. reserves the right to decide, at all times, the products offered to users through the shop. More particularly, INDUSTRIAS VALLS 1 S.A. may add new products to those already offered or included in the shop at any time, it being understood that unless otherwise established, any such new products will be governed by the provisions of the present general conditions. Similarly, INDUSTRIAS VALLS 1 S.A. reserves the right to stop rendering or providing access and use at any time, and without prior warning, of any of the different kinds of products offered in the shop.
The products included in the shop will reflect, as faithfully as possible using web display technology, those actually supplied. The characteristics of the products and their prices appear in the shop. The prices indicated in the shop are in euros and include VAT, unless otherwise indicated.
Procedure and form of payment of the products
- Within the maximum term of twenty-four (24) hours, INDUSTRIAS VALLS 1 S.A. will send an e-mail to the user, confirming the purchase. This e-mail will assign a reference code of the purchase, and will detail the characteristics of the product, its price, shipping expenses and the data of the different options for making payment of the products to INDUSTRIAS VALLS 1 S.A.
Any user purchasing a product through the shop must make payment by means of the payment systems specifically detailed in the shop.
INDUSTRIAS VALLS 1 S.A. will archive the electronic documents in which the agreement is formalised, sending a copy to the user once the purchase has been made.
The confirmation of the order sent by INDUSTRIAS VALLS 1 S.A. is not valid as an invoice, only as a receipt of purchase. INDUSTRIAS VALLS 1 S.A. will send the invoice with the product.
Right to desist
The user has a right of rejection, for which he can proceed as explained on the "Changes and Returns" page of the "Frequently Asked Questions" section.
Customer Service
For any incident, claim or use of their rights, the user must send an e-mail to shop@puntoblanco.com.
Home Delivery Service
- The territorial scope of sales through the shop is exclusively for the European Union, and deliveries will only be made in this territory. The products purchased through the shop will be sent to the delivery address given by the user once payment has been verified, the maximum term of delivery being thirty (30) days established by default in the Law.
INDUSTRIAS VALLS 1 S.A.'s delivery service is provided in collaboration with different logistics operators of acknowledged repute. No orders will be delivered to PO boxes or hotels or other non-permanent addresses.
The cost of shipment is not included in the price of the products. The user will be informed of the exact cost of shipment at the time of purchase. Shipping costs can be consulted here.
The cost and taxes that occur at the entrance of the order in the territories outside the VAT space of the E.U., are in charge of the buyer.
Intellectual and Industrial Property
- The user acknowledges that all the elements of the shop and of each one of the products, information and materials contained in them, brands, structure, selection, classification and presentation of its contents, and the computer programmes used in this regard are protected by intellectual and industrial property of INDUSTRIAS VALLS 1 S.A. or of third parties, and that the general conditions afford the user no industrial and intellectual property rights other than those specifically provided for in them.
Unless it is authorised by INDUSTRIAS VALLS 1 S.A. or, as the case may be, by the third parties holding the corresponding rights, or unless legally permitted, the user may not reproduce, transform, modify, disassemble, perform reverse engineering, distribute, rent, supply or provide access to the public via any mode of public communication, any of the elements referred to in the previous paragraph. The user must use the materials, elements and information they access through the use of the shop for their own needs only, undertaking not to use, directly or indirectly the materials, elements and information obtained through them for commercial purposes.
The user must refrain from dodging or tampering with any technical devices established by INDUSTRIAS VALLS 1 S.A. or by third parties in the shop.
Data Protection
- In compliance with applicable data protection regulations, you are hereby informed that this company processes the information you provide to us for administrative and commercial management of the VIP Club's activities, sending you advertisements and promotions related to our products and services by any means (post, email or telephone). The data provided shall be kept as long as you do not request deletion. The data is collected under your consent. User data may be communicated to the sales network (including franchises and companies from the group to which it belongs) and other entities who conduct activities necessary to meet the aforementioned purposes. You have the right to access, rectify and delete the data, as well as other rights, explained in additional information.
The responses marked with * on the registration form are obligatory. Failure to complete them will render it impossible to purchase the products selected.
Passwords
INDUSTRIAS VALLS 1 S.A. will facilitate the use of personal passwords to registered users on the website. These passwords will be used to access the services rendered on the website. The user will be responsible for keeping their passwords strictly and absolutely confidential, and will therefore be liable for any damages or consequences of any kind through the breaking or disclosure of the secret. For security reasons, the password for electronic access to the services linked to the website may be modified by the user at all times. The user undertakes to notify INDUSTRIAS VALLS 1 S.A. immediately of any unauthorised use of their password, as well as of any access by unauthorised third parties.
Cookies
- INDUSTRIAS VALLS 1 S.A. uses cookies to improve its services, facilitate browsing, maintain security, check user identity, facilitate access to personal preferences and monitor use of the shop by users. Cookies are files installed on the hard of the computer or else in the browser's memory in the folder preconfigured by the computer's operating system to user to identify it.
- If the user does not wish to have cookies installed in their hard drive, they must configure their Internet browsing programme not to receive them. Similarly, the user is free to destroy the cookies. If the user decides to deactivate the cookies, the quality and speed of service may be reduced, and access to some of the services offered in the shop may even be lost.
Applicable Law and Jurisdiction
These general conditions are governed by Spanish law. Any issues that arise on the interpretation, performance, validity or discharge of this contract will be subject to the jurisdiction and competence of the courts of law of the city of BARCELONA, with the user wavering their right to any other jurisdiction, applicable legislation permitting.
